16+ can make own decisions under mental capacity act 2005.
Under 16 can consent to treatment if they are considered to have Gillick competency, this has been common law for 30 years.
What they cannot do is decline treatment, in which case the consent of one person with parental responsibility is required. If two people with parental responsibility disagree then it will go to the court of protection.
The only person who can assess Gillick competency is a clinician. When I worked in A&E, paediatrics, any child over the age of 11 could see a physician or nurse without their parent being present, although they had to be accompanied into the department by an adult. If the child was deemed not to be Gillick competent then their parent would have to be included.
I have treated children of varying ages using Gillick competency.I would consider a 3 year old capable of consenting to having a plaster put on a wound. An 8 year old can probably consent to having a head wound glued. A 10 year old could probably consent to having sutures in a head wound.
If the clinician is convinced that the child is Gillick competent and that fact is recorded in the notes, followed by obtaining informed consent, then the procedure can continue.
Clinicians are accountable for their actions and if there is any concerns then a fitness to practice complaint can be raised with their registration body (NMC, GMC or HCPC). However, administering a medication that has been approved by the MHRA in the correct manner cannot lead to an FTP complaint.
As someone who worked as a nurse practitioner throughout 2020 seeing patients face to face in primary care, especially since GPS were not seeing patients , I take exception to people implying that we were spending time on TikTok. My former colleagues in A&E were also busy. My daughter-in-law was working in a busy ITU in a large London hospital.

These Nurses are absolute cowards. They are hiding behind their “ Big Brother -NHS”. 3 days ago I had a young female university student collapse on my doorstep. I am medically trained and subsequently applied first aid aid and called an ambulance. Her boyfriend who was with her at the time claimed she had no history of illnesses that one month previously she had been diagnosed “over the phone” by her GP that she had Long Covid. Although she had never even had COVID. She had in fact started to feel unwell post 2nd vaccination which was 2 weeks prior to the GP’s diagnosis. While waiting for ambulance to arrive, my neighbour (paediatric consultant) arrived home. She assisted me with first aid and did further tests, these revealed unilateral lower limb hyper reflexes, lower limb myoclonus, upper limb hypotonia, dysphasia, eventual loss of consciousness. All of these findings are suggestive of a neuro vascular incident ie stroke. The paramedics agreed with these findings and she was carried off to hospital. Very Very distressing for all present. People are not being informed of these events and the people at the administering end of the vaccine needle are guilty of not giving full disclosure of benefits and adverse reactions and alternative treatments. As the prospective vaccine candidate has not been fully informed, this then becomes an unlawful practice, with the administrator liable to prosecution if an adverse event occurs.

In all of your examples there is no mention of adverse effects (allergic/adverse reactions to medical treatment) which are usually covered by insurance and compensatory schemes by the medical establishment) In this instance (this untested treatment/procedure) all liability has been removed. Can you explain how you would address someone’s concerns if something were to go wrong? Where do they seek redress/compensation? As a nurse, these concerns are above your pay grade so you are not in any position to assure us of effiacy or long term safety. You should know this.

Tiktok dancing: I took exception to the tarring of every nurse/HCP with the same brush, giving specific examples of who didn’t have time due to work load. My daughter in law became physically and emotionally unwell due to stress.
George Eliot hospital wasn’t particularly busy because it is a local general hospital rather than a large acute hospital. Having worked in their A&E I know what they can and cannot do. If they have a very unwell patient they transfer them to UHCW in Coventry or to Glenfield hospital in Leicester, this is one of five ECMO sites in England.
Adverse reactions: someone stated that knowledge of these are above my pay grade as a nurse. Sorry, but you are incorrect, as a nurse practitioner I was responsible and accountable for giving medication through a PGD/PSD. I’ll give you one example from my days in A&E, a patient presented with supra ventricular tachycardia (SVT). The treatment for this is a drug called adenosine. The doctor administering the drug used the standard doses; however the patient was on another drug which basically blocked the absorption of adenosine through the blood vessel walls causing a buildup in the blood. I pointed this out to the doctor, who ignored it. The end result is that the patient became very bradycardic. So I am very aware of side effects.
I can almost guarantee (95%) that you are infected with a virus that is implicated in cancer, multiple sclerosis, type 1 diabetes and other autoimmune disorders, fortunately it is lying latent but could reactivate particularly when you are stressed. If you have had chicken pox then again you are infected with a virus for life.

Hello John Collis. Some interesting comments from a NHS Nurse. (I have Doctors/Nurses/Specialists friends/relatives in various Health Services around the world including the NHS). Nursing is a hard occupation often with little thanks.
I understand that with basic medical procedures on children such as in A n E then parents don’t need to provide permission and saves time and costs.
HOWEVER the current situation is all about INJECTING children with UNKNOWN substances. (some of the firms producing so called vaccines have refused to provide contents on the fake claim of business confidence) The public don’t have time also to read hundreds of pages to have informed consent. (Who has read the medical risks leaflet in a headache pill packet because if people did most would not take them)
The facts are thousands of deaths/disabled/illness from these JABS across the EU. (I had an Uncle in England die in terrible pain from blood clots (did not sign consent form) having had the AZ needles. He survived CV in the Care Home (negative tests) but was tied to the hospital bed with cotton mitts to prevent him pulling out the tubes more than 30 times! The Doctor who provided the needles should be struck off and charged with criminal intent as killed a human with no legitimate reason.
One of the nurses in the video needs some URGENT medical training as she claimed people who had survived CV on respirators wanted the boosters and seemed like was coercing YOUNG people to have JABS. Well it don’t take much brains to realise when someone had a disease and survived that one is immune to that disease. (Antibodies/T-Cells)
I have a daughter which is a specialist nurse in the NHS and said had CV a while ago (I asked she had various tests including blood to confirm was CV and NOT Influenza and was told no but to rest at home as NHS false claimed Influenza had vanished.) She understood and was told not to take CV JABS at least six months from illness but hospital forced them all to take otherwise sacked. Now she is NOT WELL and there will be personal HELL to those involved should she become worse!! She wore full PPE but this did not stop catching an illness which proves the face masks are also USELESS. Interesting the husband and child NEVER caught CV so the disease isn’t highly contagious and VACCINATING children is pointless and deliberate to cause harm no logical medical reason.
She has told me most of the serious sick in local hospitals at the moment are DOUBLE JABBED with lung problems including a male relative who has since DIED age 62. He was in good health with no known underlying medical conditions BEFORE took the dangerous substances.
I would be interested to see u have taken the JABS and which brands? (I am told no choice decision to the public) I have seen (Verbal/Written) information from medical contacts the rich are having FAKE saline INJECTIONS. Sorry long post but this is important and I think I have relevant experience:
According to Griffith (Griffith R. What is Gillick competence?. Hum Vaccin Immunother. 2016;12(1):244-247. doi:10.1080/21645515.2015.1091548): “Health professionals must be satisfied that the child understands: The necessity for immunization and the reasons for it; and The risks, intended benefits and outcomes of the proposed immunization and alternatives to immunization, including the option of not having or delaying the immunization…..”
However, I suspect that Gillick only applies to standard treatments that have been through all necessary testing. So if we accept that these ‘vaccines’ are experimental, you are asking a child to consent to being in an experiment. NHS research ethics committees review research into experimental treatments, an approval process that these ‘vaccines’ do not appear to have gone through… [I have a PhD in medical research, I’ve designed and conducted clinical trials, and served on a NHS ethics committee].
The argument has been made against using Gillick in most cases in relation to experimental treatment/research, apart from exceptional situations, not likely to apply here (see Hunter D, Pierscionek BK. Children, Gillick competency and consent for involvement in research. J Med Ethics. 2007;33(11):659-662).
More generally, for informed consent as part of Gillick to be upheld, you would need to have told the child that the treatment is experimental (which it seems very few people actually have been told). Even then, it seems the need for NHS ethical approval for the research should still stand.
The HRA website ultimately answers our question, Research involving children – Health Research Authority (hra.nhs.uk):
“The Medicines for Human Use (Clinical Trials) Regulations prohibit children under the age of 16 from giving consent to take part in a Clinical Trial of an Investigational Medicinal Product (CTIMP).
Those who are able to give consent on behalf of children / young people, to take part in a CTIMP, in the UK are:
– parent or someone with parental responsibility (agreement of only one parent is required)
– personal legal representative i.e. a person not connected with the conduct of the trial who is suitable to act as the legal representative by virtue of their relationship with the child / young person, and is available and willing to do so
– a legal representative should only ever be approached if someone with parental responsibility cannot be contacted prior to the proposed inclusion of the child / young person, by reason of the urgent nature of the treatment provided as part of the trial.”
“In the absence of law relating specifically to research, it is commonly assumed that the principle of ‘Gillick competence’ can be applied not only to consent for treatment, but also to consent for research.”
So, if the child is under 16 and it is a CTIMP (including experimental vaccines), Gillick CANNOT be applied. ‘Commonly assume’ does not trump the stated restriction, although some people may be misled. In other words, they have to claim that this is not a clinical trial in order to inject children without parental consent. Interestingly, this guidance was last updated on 6th Sept 2021.
Consent for non-experimental treatment:
Griffith also states “To date no court has found a child in need of life sustaining treatment competent to refuse that treatment.” This latter point is very specific, and I don’t think these ‘vaccines’ fall into the category of life sustaining (!), so if the vaccine was to pass through the experimental phase and become a standard treatment then under Gilllick children should have the right to refuse as much as they could accept. However, the article does state that a parent could still consent for the child if the child refuses. It would seem there is a bias towards treatment…

When you read the Judgement of the Gillick case and subsequent cases a person cannot be Gillick competent unless they have full understanding and be informed of the FULL RISKS. No child, let alone any adult, is being told the true risks of these vaccines let alone what is in them. Most GP’s don’t even know what is in them. The possible adverse reactions are all recorded on the MHRA website so it is not difficult. So if you said to anyone, there is a chance of a blood clot, stroke, heart attack, blindness or paralysis- albeit small- just how many do you think would roll up their sleeves exactly? Gillick competence is not being satisfied. I appreciate that some medics were busy in 2020 that’s why you were getting paid when so many were losing their jobs. I was busy too as were those working in the supermarkets and driving vans etc. The medical profession have brought disrepute upon themselves because “some” were making videos and playing on their phones, wards were shut down and patients with other serious illnesses were turned away. The receptionist at my own GP surgery confirms to me that our GP’s were not overly busy in Spring 2020 and yet they closed their doors and locked out desperate sick people and as a result some sat at home and died. Are not ICU’s in a large London Hospital always busy and especially in respiratory illness seasons?

A child will never ever be given an aspirin. You need to read the full Gillick judgement, it may have been for contraceptive advice (note that the contraceptive pill can be given for other reasons), but the judgement actually makes sense.
If you were to ask either of these idiots to cite the actual Gillick case and to what it referred, they would be stumped. To the woman/nurse in the video… Does Gillick competency apply when you are explaining to the child that all liability has been removed for adverse effects? Would the child understand the implication that they ‘are on their own in this’? You would have to tell them there is no medical treatment or compensation available if something should go wrong. Some of them will understand, some of them won’t. Problem is… none of this is mentioned is it? I would love to be a fly on the wall to hear how they ‘inform’ a Gillick competent child. My parents had the booster last Thursday and felt fine but on Friday morning when I popped over to see them they were still in bed as they felt really really ill. As in they felt dizzy, sick and achy all over. Obviously I was worried about them and I love them to bits but I thought to myself if that’s what a booster does I’m glad I’ve not even had the 2nd jab. According to Griffith (Griffith R. What is Gillick competence?. Hum Vaccin Immunother. 2016;12(1):244-247): “Health professionals must be satisfied that the child understands: The necessity for immunization and the reasons for it; and The risks, intended benefits and outcomes of the proposed immunization and alternatives to immunization, including the option of not having or delaying the immunization…..”
However, I suspect Gillick only applies to standard treatments that have been through all necessary testing. So as the ‘vaccines’ are experimental, a child is consenting to being in an experiment. NHS research ethics committees review research into experimental treatments, an approval process that these ‘vaccines’ do not appear to have gone through… [I have a PhD in medical research, I’ve designed and conducted clinical trials, and served on a NHS ethics committee].
The argument has been made against using Gillick in most cases in relation to experimental treatment/research, apart from exceptional situations, not likely to apply here (see Hunter D, Pierscionek BK. Children, Gillick competency and consent for involvement in research. J Med Ethics. 2007;33(11):659-662).
Anyway, for informed consent as part of Gillick, you would need to have told the child that the treatment is experimental and the need for NHS research ethics approval should still stand.
The HRA website ultimately answers our question, Research involving children – Health Research Authority (hra.nhs.uk): “The Medicines for Human Use (Clinical Trials) Regulations prohibit children under the age of 16 from giving consent to take part in a Clinical Trial of an Investigational Medicinal Product (CTIMP). Those who are able to give consent on behalf of children/young people, to take part in a CTIMP, in the UK are:
– parent or someone with parental responsibility (agreement of only one parent is required)
– personal legal representative i.e. a person not connected with the conduct of the trial who is suitable to act as the legal representative by virtue of their relationship with the child/young person, and is available and willing to do so
– a legal representative should only ever be approached if someone with parental responsibility cannot be contacted…”
“In the absence of law relating specifically to research, it is commonly assumed that the principle of ‘Gillick competence’ can be applied not only to consent for treatment, but also to consent for research.”
So, if the child is under 16 and it is a CTIMP (i.e. experimental vaccine), Gillick CANNOT be applied. ‘Commonly assume’ does not trump the stated restriction, although some people may be misled. In other words, they have to claim that this is not a clinical trial in order to inject children without parental consent. Interestingly, this guidance was last updated on 6th Sept 2021.
Griffith also states “To date no court has found a child in need of life sustaining treatment competent to refuse that treatment.” I don’t think these ‘vaccines’ fall into the category of life sustaining (!), so if the vaccine was to become a standard treatment then under Gilllick children should have the right to refuse as much as they could accept. However, the article does state that a parent could still consent for the child if the child refuses …

Also it’s worrying that you have nurses trying to claim kids have Gillick competence when she doesn’t even know the facts regarding who is in hospital, she actually believes everyone who gets the jab doesn’t get ill, even though she already said people are coming for boosters after being on a ventilator.
I think her competence needs evaluating, first as a nurse, second her intellectual capacity, and third if she is fit to even talk to members of the public.
16+ can make own decisions under mental capacity act 2005.
Under 16 can consent to treatment if they are considered to have Gillick competency, this has been common law for 30 years.
What they cannot do is decline treatment, in which case the consent of one person with parental responsibility is required. If two people with parental responsibility disagree then it will go to the court of protection.
The only person who can assess Gillick competency is a clinician. When I worked in A&E, paediatrics, any child over the age of 11 could see a physician or nurse without their parent being present, although they had to be accompanied into the department by an adult. If the child was deemed not to be Gillick competent then their parent would have to be included.
I have treated children of varying ages using Gillick competency.I would consider a 3 year old capable of consenting to having a plaster put on a wound. An 8 year old can probably consent to having a head wound glued. A 10 year old could probably consent to having sutures in a head wound.
If the clinician is convinced that the child is Gillick competent and that fact is recorded in the notes, followed by obtaining informed consent, then the procedure can continue.
Clinicians are accountable for their actions and if there is any concerns then a fitness to practice complaint can be raised with their registration body (NMC, GMC or HCPC). However, administering a medication that has been approved by the MHRA in the correct manner cannot lead to an FTP complaint.
As someone who worked as a nurse practitioner throughout 2020 seeing patients face to face in primary care, especially since GPS were not seeing patients , I take exception to people implying that we were spending time on TikTok. My former colleagues in A&E were also busy. My daughter-in-law was working in a busy ITU in a large London hospital.

These Nurses are absolute cowards. They are hiding behind their “ Big Brother -NHS”. 3 days ago I had a young female university student collapse on my doorstep. I am medically trained and subsequently applied first aid aid and called an ambulance. Her boyfriend who was with her at the time claimed she had no history of illnesses that one month previously she had been diagnosed “over the phone” by her GP that she had Long Covid. Although she had never even had COVID. She had in fact started to feel unwell post 2nd vaccination which was 2 weeks prior to the GP’s diagnosis. While waiting for ambulance to arrive, my neighbour (paediatric consultant) arrived home. She assisted me with first aid and did further tests, these revealed unilateral lower limb hyper reflexes, lower limb myoclonus, upper limb hypotonia, dysphasia, eventual loss of consciousness. All of these findings are suggestive of a neuro vascular incident ie stroke. The paramedics agreed with these findings and she was carried off to hospital. Very Very distressing for all present. People are not being informed of these events and the people at the administering end of the vaccine needle are guilty of not giving full disclosure of benefits and adverse reactions and alternative treatments. As the prospective vaccine candidate has not been fully informed, this then becomes an unlawful practice, with the administrator liable to prosecution if an adverse event occurs.

In all of your examples there is no mention of adverse effects (allergic/adverse reactions to medical treatment) which are usually covered by insurance and compensatory schemes by the medical establishment) In this instance (this untested treatment/procedure) all liability has been removed. Can you explain how you would address someone’s concerns if something were to go wrong? Where do they seek redress/compensation? As a nurse, these concerns are above your pay grade so you are not in any position to assure us of effiacy or long term safety. You should know this.

I think you just said that a child is Gillick competent if they agree with the nurse/physician to a procedure, but will be judged not competent if they refuse. I don’t think people in positions of power in health settings are aware of the imbalance of power they wield.
To answer some of the criticism:
Tiktok dancing: I took exception to the tarring of every nurse/HCP with the same brush, giving specific examples of who didn’t have time due to work load. My daughter in law became physically and emotionally unwell due to stress.
George Eliot hospital wasn’t particularly busy because it is a local general hospital rather than a large acute hospital. Having worked in their A&E I know what they can and cannot do. If they have a very unwell patient they transfer them to UHCW in Coventry or to Glenfield hospital in Leicester, this is one of five ECMO sites in England.
Adverse reactions: someone stated that knowledge of these are above my pay grade as a nurse. Sorry, but you are incorrect, as a nurse practitioner I was responsible and accountable for giving medication through a PGD/PSD. I’ll give you one example from my days in A&E, a patient presented with supra ventricular tachycardia (SVT). The treatment for this is a drug called adenosine. The doctor administering the drug used the standard doses; however the patient was on another drug which basically blocked the absorption of adenosine through the blood vessel walls causing a buildup in the blood. I pointed this out to the doctor, who ignored it. The end result is that the patient became very bradycardic. So I am very aware of side effects.
I can almost guarantee (95%) that you are infected with a virus that is implicated in cancer, multiple sclerosis, type 1 diabetes and other autoimmune disorders, fortunately it is lying latent but could reactivate particularly when you are stressed. If you have had chicken pox then again you are infected with a virus for life.
Hello John Collis. Some interesting comments from a NHS Nurse. (I have Doctors/Nurses/Specialists friends/relatives in various Health Services around the world including the NHS). Nursing is a hard occupation often with little thanks.
I understand that with basic medical procedures on children such as in A n E then parents don’t need to provide permission and saves time and costs.
HOWEVER the current situation is all about INJECTING children with UNKNOWN substances. (some of the firms producing so called vaccines have refused to provide contents on the fake claim of business confidence) The public don’t have time also to read hundreds of pages to have informed consent. (Who has read the medical risks leaflet in a headache pill packet because if people did most would not take them)
The facts are thousands of deaths/disabled/illness from these JABS across the EU. (I had an Uncle in England die in terrible pain from blood clots (did not sign consent form) having had the AZ needles. He survived CV in the Care Home (negative tests) but was tied to the hospital bed with cotton mitts to prevent him pulling out the tubes more than 30 times! The Doctor who provided the needles should be struck off and charged with criminal intent as killed a human with no legitimate reason.

Sorry long post but this is important and I think I have relevant experience:
According to Griffith (Griffith R. What is Gillick competence?. Hum Vaccin Immunother. 2016;12(1):244-247. doi:10.1080/21645515.2015.1091548): “Health professionals must be satisfied that the child understands: The necessity for immunization and the reasons for it; and The risks, intended benefits and outcomes of the proposed immunization and alternatives to immunization, including the option of not having or delaying the immunization…..”
However, I suspect that Gillick only applies to standard treatments that have been through all necessary testing. So if we accept that these ‘vaccines’ are experimental, you are asking a child to consent to being in an experiment. NHS research ethics committees review research into experimental treatments, an approval process that these ‘vaccines’ do not appear to have gone through… [I have a PhD in medical research, I’ve designed and conducted clinical trials, and served on a NHS ethics committee].
The argument has been made against using Gillick in most cases in relation to experimental treatment/research, apart from exceptional situations, not likely to apply here (see Hunter D, Pierscionek BK. Children, Gillick competency and consent for involvement in research. J Med Ethics. 2007;33(11):659-662).
More generally, for informed consent as part of Gillick to be upheld, you would need to have told the child that the treatment is experimental (which it seems very few people actually have been told). Even then, it seems the need for NHS ethical approval for the research should still stand.
The HRA website ultimately answers our question, Research involving children – Health Research Authority (hra.nhs.uk):
“The Medicines for Human Use (Clinical Trials) Regulations prohibit children under the age of 16 from giving consent to take part in a Clinical Trial of an Investigational Medicinal Product (CTIMP).
Those who are able to give consent on behalf of children / young people, to take part in a CTIMP, in the UK are:
– parent or someone with parental responsibility (agreement of only one parent is required)
– personal legal representative i.e. a person not connected with the conduct of the trial who is suitable to act as the legal representative by virtue of their relationship with the child / young person, and is available and willing to do so
– a legal representative should only ever be approached if someone with parental responsibility cannot be contacted prior to the proposed inclusion of the child / young person, by reason of the urgent nature of the treatment provided as part of the trial.”
“In the absence of law relating specifically to research, it is commonly assumed that the principle of ‘Gillick competence’ can be applied not only to consent for treatment, but also to consent for research.”
So, if the child is under 16 and it is a CTIMP (including experimental vaccines), Gillick CANNOT be applied. ‘Commonly assume’ does not trump the stated restriction, although some people may be misled. In other words, they have to claim that this is not a clinical trial in order to inject children without parental consent. Interestingly, this guidance was last updated on 6th Sept 2021.
Consent for non-experimental treatment:
Griffith also states “To date no court has found a child in need of life sustaining treatment competent to refuse that treatment.” This latter point is very specific, and I don’t think these ‘vaccines’ fall into the category of life sustaining (!), so if the vaccine was to pass through the experimental phase and become a standard treatment then under Gilllick children should have the right to refuse as much as they could accept. However, the article does state that a parent could still consent for the child if the child refuses. It would seem there is a bias towards treatment…
When you read the Judgement of the Gillick case and subsequent cases a person cannot be Gillick competent unless they have full understanding and be informed of the FULL RISKS. No child, let alone any adult, is being told the true risks of these vaccines let alone what is in them. Most GP’s don’t even know what is in them. The possible adverse reactions are all recorded on the MHRA website so it is not difficult. So if you said to anyone, there is a chance of a blood clot, stroke, heart attack, blindness or paralysis- albeit small- just how many do you think would roll up their sleeves exactly? Gillick competence is not being satisfied. I appreciate that some medics were busy in 2020 that’s why you were getting paid when so many were losing their jobs. I was busy too as were those working in the supermarkets and driving vans etc. The medical profession have brought disrepute upon themselves because “some” were making videos and playing on their phones, wards were shut down and patients with other serious illnesses were turned away. The receptionist at my own GP surgery confirms to me that our GP’s were not overly busy in Spring 2020 and yet they closed their doors and locked out desperate sick people and as a result some sat at home and died. Are not ICU’s in a large London Hospital always busy and especially in respiratory illness seasons?

Gillick competency is common law and can be changed only by the Supreme Court or an act of parliament, so it cannot have been proven to be unlawful as there has been no judicial review or debate in parliament.

To the woman/nurse in the video… Does Gillick competency apply when you are explaining to the child that all liability has been removed for adverse effects? Would the child understand the implication that they ‘are on their own in this’? You would have to tell them there is no medical treatment or compensation available if something should go wrong. Some of them will understand, some of them won’t. Problem is… none of this is mentioned is it? I would love to be a fly on the wall to hear how they ‘inform’ a Gillick competent child. And who decides this competency at the time of vaccination, a nurse with a small questionair? I thought a qualified psychiatrist had to do that?
Amazingly, she argues the point for the couple serving the liability order, and has no idea she did so. That’s quite something, really.
My parents had the booster last Thursday and felt fine but on Friday morning when I popped over to see them they were still in bed as they felt really really ill. As in they felt dizzy, sick and achy all over. Obviously I was worried about them and I love them to bits but I thought to myself if that’s what a booster does I’m glad I’ve not even had the 2nd jab. They even had to cancel the flu jab that was booked for Saturday morning because they felt that ill. Fortunately by Sunday they had recovered. I mean ok so it was just a bad reaction but even so it’s not nice. I notice in the video the nurse couldn’t really give an explanation when the guy said about the amount of vaccinated people in Hospital with the Delta variant.
“How can we be held liable?” Therein lies one of the problems. One, the problem of ignorance of both their responsibilities to know what they are doing in administering an inadequately tested vaccine – which they readily admit – and their ignorance that they can & will be held liable under International Law. ‘I was just doing what I was told’ is not a defence.
Where they in a back street in that video ? Dishing out there legal drugs. On a vent means put in an induced coma surley? Virus in Latin means poison/venom says it all really. Virus contagion has never been proven. They have always been poisoning us. Air, water, food, big pharma, EMF etc. Its now coming out in the open as more people question the covid narrative and research for themselves.. As it says in the cancer research advert 1 in 2 people will get cancer. The question is WHY. We are just their cash cows and always have been.
According to Griffith (Griffith R. What is Gillick competence?. Hum Vaccin Immunother. 2016;12(1):244-247): “Health professionals must be satisfied that the child understands: The necessity for immunization and the reasons for it; and The risks, intended benefits and outcomes of the proposed immunization and alternatives to immunization, including the option of not having or delaying the immunization…..”
However, I suspect Gillick only applies to standard treatments that have been through all necessary testing. So as the ‘vaccines’ are experimental, a child is consenting to being in an experiment. NHS research ethics committees review research into experimental treatments, an approval process that these ‘vaccines’ do not appear to have gone through… [I have a PhD in medical research, I’ve designed and conducted clinical trials, and served on a NHS ethics committee].
The argument has been made against using Gillick in most cases in relation to experimental treatment/research, apart from exceptional situations, not likely to apply here (see Hunter D, Pierscionek BK. Children, Gillick competency and consent for involvement in research. J Med Ethics. 2007;33(11):659-662).
Anyway, for informed consent as part of Gillick, you would need to have told the child that the treatment is experimental and the need for NHS research ethics approval should still stand.
The HRA website ultimately answers our question, Research involving children – Health Research Authority (hra.nhs.uk): “The Medicines for Human Use (Clinical Trials) Regulations prohibit children under the age of 16 from giving consent to take part in a Clinical Trial of an Investigational Medicinal Product (CTIMP). Those who are able to give consent on behalf of children/young people, to take part in a CTIMP, in the UK are:
– parent or someone with parental responsibility (agreement of only one parent is required)
– personal legal representative i.e. a person not connected with the conduct of the trial who is suitable to act as the legal representative by virtue of their relationship with the child/young person, and is available and willing to do so
– a legal representative should only ever be approached if someone with parental responsibility cannot be contacted…”
“In the absence of law relating specifically to research, it is commonly assumed that the principle of ‘Gillick competence’ can be applied not only to consent for treatment, but also to consent for research.”
So, if the child is under 16 and it is a CTIMP (i.e. experimental vaccine), Gillick CANNOT be applied. ‘Commonly assume’ does not trump the stated restriction, although some people may be misled. In other words, they have to claim that this is not a clinical trial in order to inject children without parental consent. Interestingly, this guidance was last updated on 6th Sept 2021.
Griffith also states “To date no court has found a child in need of life sustaining treatment competent to refuse that treatment.” I don’t think these ‘vaccines’ fall into the category of life sustaining (!), so if the vaccine was to become a standard treatment then under Gilllick children should have the right to refuse as much as they could accept. However, the article does state that a parent could still consent for the child if the child refuses …
